Agreement to Terms

By accessing or using CustodyTrac, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use the service. CustodyTrac is a free co-parenting platform designed to help separated or divorced parents manage custody schedules, medical records, and legal documentation.

Free Service

CustodyTrac is free to download, install, and use for both parents. There are no subscription fees, no premium tiers, and no per-parent charges. We reserve the right to introduce paid features in the future, but the core co-parenting functionality will always remain free.

User Accounts

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your account credentials.
You may not share your account with others or use another user's account without permission.
CustodyTrac supports role-based access (Parent, Attorney, Mediator). You are responsible for properly assigning and managing these roles.

Acceptable Use

You agree not to use CustodyTrac to:

Upload false or misleading information intended to deceive a co-parent, attorney, or court.
Harass, threaten, or intimidate any other user through the platform.
Attempt to bypass security measures or access another user's data without authorization.
Use the service for any purpose other than legitimate co-parenting coordination.
Reverse engineer, decompile, or disassemble any portion of the application.

User Content & Uploaded Documents

Sole Responsibility of the Uploading Party

You are solely and exclusively responsible for all documents, records, photographs, messages, medical information, school records, and any other materials you upload, store, or transmit through CustodyTrac ("User Content"). By uploading User Content, you represent and warrant that you own such content or possess the full legal right, authority, and consent necessary to upload it, and that doing so does not violate any court order, custody decree, confidentiality or non-disclosure agreement, privacy right, or any other right of any third party — including rights relating to medical, educational, or personal information concerning minors or your co-parent.

No Review, Verification, or Endorsement

CustodyTrac does not review, verify, authenticate, monitor, or endorse any User Content, and assumes no duty to do so. CustodyTrac does not act as a custodian of evidence, and storage of User Content on the platform does not constitute a legal filing, a sworn record, or a guarantee of admissibility in any legal proceeding.

No Warranties Regarding User Content

ALL USER CONTENT IS STORED AND MADE AVAILABLE "AS IS." CUSTODYTRAC MAKES NO WARRANTY OR GUARANTEE OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING ANY WARRANTY OF ACCURACY, LEGALITY, COMPLETENESS, RELIABILITY, PRIVACY, OR FITNESS FOR ANY LEGAL PURPOSE — WITH RESPECT TO USER-UPLOADED MATERIALS. Any reliance on User Content by you, your co-parent, or any legal professional is strictly at your own risk.

Indemnification

You agree to indemnify, defend, and hold harmless CustodyTrac, its parent company, officers, directors, employees, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) User Content you upload, store, or share; (b) your breach of any representation or warranty in these Terms; or (c) your violation of any right of any third party, including any privacy, publicity, or intellectual property right.

Removal & Legal Disclosure

CustodyTrac reserves the right, but has no obligation, to remove, restrict access to, or preserve User Content at its discretion or as required by law, subpoena, or court order. CustodyTrac may disclose User Content when legally compelled to do so.

Advertising & Affiliate Disclosures

Third-Party Recommendations

CustodyTrac may display recommendations for third-party services, products, or resources within the app portal. These recommendations may include affiliate links, meaning CustodyTrac may earn a commission or referral fee if you purchase or sign up for a recommended service through our link.

Disclaimers

CustodyTrac is provided "as is" and "as available" without warranties of any kind. While we maintain tamper-proof audit logs and legal-grade records, we are not a law firm and do not provide legal advice. The platform is designed to support your co-parenting coordination and documentation — it does not replace the advice of a qualified family law attorney.

Without limiting the foregoing, CustodyTrac expressly disclaims all warranties, express or implied, with respect to User Content uploaded by you or any other user, including any warranty of accuracy, authenticity, legality, privacy, or admissibility in any legal or administrative proceeding. Responsibility for all uploaded materials rests solely with the party who uploaded them.

We do not guarantee that the service will be uninterrupted, timely, secure, or error-free. You use the service at your own risk.

Limitation of Liability

To the maximum extent permitted by law, CustodyTrac and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service. This includes damages for loss of profits, goodwill, data, or other intangible losses.

Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any material changes by posting the new terms on this page with an updated "Last updated" date. Your continued use of the service after any changes constitutes acceptance of the revised terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
